ERIE – A full-service drilling company alleges that it is owed an early termination fee from a Wexford business.
Orion Drilling Co. LLC filed a complaint on Aug. 30 in the U.S. District Court for the Western District of Pennsylvania against Apex Energy (PA) LLC alleging breach of contract.
According to the complaint, the plaintiff and defendant executed a contract in January for the plaintiff to drill four natural gas wells in Westmoreland County. The plaintiff alleges the defendant terminated the contract early in May.
The plaintiff holds Apex Energy (PA), LLC responsible because the defendant allegedly owes a termination fee to the plaintiff for prematurely terminating their contract.
The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $638,700 plus interest, court costs and any further relief this court grants. It is represented by Andrew K. Fletcher and Kevin M. Eddy of Pepper Hamilton LLP in Pittsburgh.
