FTS International Services employee alleges he was misclassified

SCRANTON – A field supervisor alleges he was misclassified from receiving overtime pay.

Joshua Flook filed a complaint on Aug. 31 in the U.S. District Court for the Middle District of Pennsylvania against FTS International Services LLC and John Does 1-10 citing the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff was hired by J-W Wireline in June 2014 and that the defendants later bought the company and kept the plaintiff in the same position.

The plaintiff holds FTS International Services LLC and John Does 1-10 responsible because the defendants allegedly misclassified the plaintiff and failed to pay overtime at a rate of time-and-one-half.

The plaintiff seeks compensation of all pay and benefits, liquidated damages, court costs and any further relief the court grants. He is represented by Matthew D. Miller, Justin L. Swidler and Richard S. Swartz of Swartz Swidler LLC in Cherry Hill, New Jersey.
