Field supervisor alleges FTS International Services did not pay overtime wages

SCRANTON – A Loganton man alleges that he did not receive the correct wage rate for overtime work.

Derek Dershem filed a complaint on Aug. 31 in the U.S. District Court for the Middle District of Pennsylvania against FTS International Services LLC citing the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff was hired by J-W Wireline in June 2014 as a field supervisor and that the defendants later bought the company and kept the plaintiff in the same position. The suit states the plaintiff worked out of the Muncy office.

The plaintiff holds FTS International Services LLC and John Does 1-10 responsible because the defendants allegedly misclassified the plaintiff and failed to pay overtime at a rate of time-and-one-half.

The plaintiff seeks compensation of all pay and benefits, liquidated damages, court costs and any further relief the court grants. He is represented by Matthew D. Miller, Justin L. Swidler and Richard S. Swartz of Swartz Swidler LLC in Cherry Hill, New Jersey.
