North American Communications Inc. seeks declaration regarding payments

JOHNSTOWN – A Duncanville corporation is seeking judgment regarding a breach of retirement agreement claim.

North American Communications Inc. filed a complaint on Aug. 29 in the U.S. District Court for the Western District of Pennsylvania, Johnstown Division against Michael Herman seeking declaratory judgment and alleging breach of contract.

According to the complaint, the defendant was a beneficial owner of 50 percent of the stock NAC and was an officer and board of directors member.

The plaintiff alleges that Herman breached the agreement and because of that, the plaintiff is entitled a declaration that it does not owe any further payments to the defendant under the agreement's terms.

The plaintiff seeks declare that the defendant breached the terms of the agreement and that no future payments are due; consequential, compensatory, incidental and special damages; injunctive relief and any further relief the court grants. It is represented by Timothy J. Nieman and William C. Boak of Rhoads & Sinon LLP in Harrisburg.
