Legend Smelting and Recycling Inc. alleges it wasn't paid for scrap metal sold

HARRISBURG – An Ohio scrap metal business alleges it is owed more than $300,000 for metal it delivered.

Legend Smelting and Recycling Inc. filed a complaint on Aug. 30 in the U.S. District Court for the Middle District of Pennsylvania against White Metal Recycling LLC; Scrap Transport LLC; House of Windsor Inc.; American Aluminum Alloys LLC; Creed F. White also known as Zach Feinstein; John Doe Nos. 1-10, and ABC corporation Nos. 1-10 alleging breach of contract and other counts.

According to the complaint, the plaintiff and American Aluminum Alloys agreed for the defendant to purchase scrap metal from the plaintiff and invoices were sent this year.

The plaintiff holds White Metal Recycling LLC; Scrap Transport LLC; House of Windsor Inc.; American Aluminum Alloys LLC; White also known as Zach Feinstein; John Doe Nos. 1-10, and ABC corporation Nos. 1-10 responsible because the defendants allegedly breached their contractual agreement with the plaintiff by failing to pay them based on their agreement. The plaintiff alleges it is owed $327,224.69.

The plaintiff requests a trial by jury and seeks all damages, punitive damages, interest, court costs and any further relief this court grants. They are represented by Benjamin DiLorenzo of Bressler, Amery & Ross P.C. in Florham Park, New Jersey.
