PHILADELPHIA - A Philadelphia woman alleges a debt collector failed to mark an account as disputed.
Casaundra Sheppard, also known as Casaundra Riley, filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania July 14 against Bay Area Receivables Inc., alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff had disputed a debt with the defendant on Dec. 29, 2016. She alleges that when she checked her credit report in March, the defendant had re-reported the alleged debt and had failed to mark it as disputed.
The plaintiff holds Bay Area Receivables responsible because the defendant's alleged failure to mark the alleged debt as disputed caused her credit score to lower roughly 60 points.
The plaintiff seeks actual damages, statutory damages, court costs and any further relief the court grants. She is represented by Antranig Garibian of Garibian Law Offices PC in Philadelphia.
