DePuy Synthes Sales Inc. alleges former employees are breaching agreement with work for competitor

PHILADELPHIA - A West Chester corporation is seeking to prevent two California individuals from using confidential and trade secret information.

DePuy Synthes Sales Inc. filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania July 21 against David Garfinkel and Joseph Johnson.

According to the complaint, the plaintiff alleges the defendants, who are former sales employees of the plaintiff, have violated their post-employment contractual obligations by working for competitor KLS Martin Inc.

The plaintiff holds Garfinkel and Johnson responsible because the defendants allegedly are soliciting the business of their former customers while working for the plaintiff and for their new employer.

The plaintiff seeks actual damages, incidental and consequential damages, damages or disgorgement, all profits, injunctive relief, court costs, interest and any further relief the court grants. It is represented by Anthony B. Haller and Leigh Ann Buziak of Blank Rome LLP in Philadelphia.
