Man alleges he was terminated from PF Holdings LLC over overtime complaints

PHILADELPHIA - A Philadelphia man alleges he was retaliated against when he complained about not receiving overtime pay.

Francisco Aracena filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania Sept. 11 against Pavilion Apartments Penn LLC, PF Holdings LLC and Eli Frischman, citing the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the Pavilion Apartments Penn as a maintenance technician before it was acquired by PF Holdings. He alleges when PF Holdings acquired the company, his title was changed to service manager and he was converted to a salaried position and no longer paid overtime wages.

The plaintiff holds Pavilion Apartments Penn LLC, PF Holdings LLC and Frischman responsible because the defendants allegedly failed to pay overtime wages to the plaintiff and terminated him in August because of his complaints of unpaid overtime wages.

The plaintiff seeks compensation, all pay and benefits, liquidated and punitive damages, court costs, damages and any further relief the court grants. He is represented by Ari Karpf of Karpf Karpf & Cerutti PC in Bensalem.
