Labor union alleges it is owed funds from NJ employer

PHILADELPHIA - A New Jersey employer allegedly owes contributions to a labor union and its fund.

Retail, Wholesale, Department Store Union Local 1034; Retail, Wholesale, Department Store Union Local 1034 Welfare Trust Fund; and trustee Gary Barker of the Retail, Wholesale, Department Store Union Local 1034 Welfare Trust Fund filed a complaint in the U.S. District Court for the Eastern District of Pennsylvania Sept. 14 against Innova Burlington Church Operations LLC, doing business as Mount Laurel Center for Rehab and also known as Centers for Specialty, citing the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege the defendant has failed to remit reports or contributions for the months of June to August. They allege the defendant has been notified of the delinquencies but has failed to make payments.

The plaintiffs seek all amounts due and owing, interest, all legal fees, injunctive relief, liquidated damages and any other relief as the court deems just. They are represented by Nicholas J. Botta of Spear Wilderman PC in Philadelphia.
