PHILADELPHIA – An insurance firm is seeking subrogation from a Pottstown company over water damages allegedly caused by a fire protection system.
North American Elite Insurance Co., as subgrogee of Penn Foundation Inc., filed a complaint on Aug. 4 in the U.S. District Court for the Eastern District of Pennsylvania against Victory Fire Protection Inc. alleging negligence.
According to the complaint, the plaintiff issued an insurance policy to Penn Foundation to insure its Sellersville property and that the defendant was retained to install a fire protection system at the property. The suit states that a piping connection froze and broke in the fire protection system in January 2016, which caused water damage to the property. The plaintiff alleges it incurred damages of $373,651.20 as a result.
The plaintiff holds Victory Fire Protection Inc. responsible because the defendant allegedly failed to properly perform work and failed to warn the Penn Foundation of the dangerous and hazardous condition.
The plaintiff requests a trial by jury and seeks all damages, interest, court costs and any further relief the court grants. It is represented by Daniel C. Theveny of Cozen O'Connor PC in Philadelphia.
