Eclipse Acqui Inc. alleged to have breached contract regarding loan information

JOHNSTOWN – A Duncansville corporation claims a California corporation failed to provide information needed to pay a loan.

North American Communications Inc., NAC Logistics LLC, HMS Global Direct LLC and HMS Global Direct 2 LLC filed a complaint on Sept. 13 in the U.S. District Court for the Western District of Pennsylvania against Eclipse Acqui Inc. alleging breach of contract.

According to the complaint, NAC and AloStar Bank of Commerce entered into a loan and security agreement in May 2015. The parties entered into a forbearance agreement in July, the suit states.

The suit states that the defendant was advised by NAC that the plaintiff intended to pay off the amounts due under the loan, but the defendant allegedly failed to provide the payoff information or instructions that would have enabled the plaintiff to pay the amount due by Aug. 23.

The plaintiffs request a trial by jury and seek consequential, compensatory, incidental, special and punitive damages, court costs and any further relief the court grants. They are represented by Timothy J. Nieman and William C. Boak of Rhoads & Sinon LLP in Harrisburg.
