Golden Gate National Senior Care, others seek arbitration for dispute filed by Puyallup woman

JOHNSTOWN – The operators of a skilled nursing facility are seeking to compel a Puyallup woman's complaint into arbitration.

Golden Gate National Senior Care LLC; GGNSC Meyersdale LP, doing business as Golden Living Center - Meyersdale; et al. filed a complaint to compel arbitration on Sept. 13 in the U.S. District Court for the Western District of Pennsylvania against Hope N. Hendershot-Brown, administratrix for the estate of John R. Hendershot.

According to the complaint, the defendant filed a civil case against the plaintiffs on Sept. 1 in the Somerset County Court of Common Pleas. The suit states that Hendershot was a former resident of the the plaintiffs' facility and he executed an admission agreement in October 2015. They allege that all disputes must be submitted in accordance with the terms of the agreement and that the court action should be stayed.

The plaintiffs request that the court enter an order finding the agreement to be valid and enforceable and compel the defendant to submit claims in accordance with the agreement. They are represented by Patrick L. Mechas and Andrew C. Hazi of Burns White LLC in Pittsburgh.
