Man names Peterbilt Motors Co., others in suit over allegedly defective truck

PHILADELPHIA – A Pittston couple allege the husband was burned and injured while working on a truck.

James Burnside and Maria Burnside filed a complaint on Sept. 20 in the U.S. District Court for the Eastern District of Pennsylvania against Peterbilt Motors Co., Arrow Tank and Engineering Co., RegO Products and Federal Tank Testing Inc. alleging product liability, negligence and other counts.

According to the complaint, James Burnside was acting in the scope of his employment for Modern Gas and Oil of Avoca on July 21 and was working on a bobtail truck built, sold or inspected by the defendants. He alleges that the truck began leaking propane gas without warning and the gas caught fire, burning the plaintiff.

The plaintiffs holds Peterbilt Motors Co., Arrow Tank and Engineering Co., RegO Products and Federal Tank Testing Inc. responsible because the truck allegedly was unsafe for consumer use and its component parts were defective.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount of more than $150,000 plus interest, court costs and any further relief the court grants. They are represented by Brandon A. Swartz, Bryan M. Ferris and Maria K. McGinty-Ferris of Swartz Culleton PC in Newtown.
