READING – A Stockertown corporation alleges that a New York individual is selling competing products under an unauthorized mark.
A&H Sportswear Co. Inc. filed a complaint on Sept. 20 in the U.S. District Court for the Eastern District of Pennsylvania against Jennifer Vrionides, doing business as Miracle Waist Shapers, alleging that the business owner used plaintiff's trademarks without her consent.
According to the complaint, the plaintiff is the owner of the Miraclesuit, Miracleshaper and other Miracle marks in association with swimwear and shapewear. The plaintiff holds Vrionides responsible because the defendant allegedly offered and sold swimwear and shapewear under the marks Miracle Waist Shaper, Miracle Waist and Miracle Beauties.
The plaintiff requests a trial by jury and seeks to enjoin the defendant and her agents from further infringing plaintiff's trademark, order the destruction of all infringing materials and products, order to cancel all other domain names and social media webpages that the defendant controls containing the Miracle marks, pay all profits to the plaintiff, damages, interest, punitive damages, court costs and any further relief the court grants.
