A & H Sportswear Co. claims Miami company is unlawfully using Miracle marks for shapewear products

READING – A Stockertown corporation alleges an individual and company in Miami are unlawfully using its trademarks to sell shapewear.

A & H Sportswear Co. Inc. filed a complaint on Sept. 20 in the U.S. District Court for the Eastern District of Pennsylvania against Pre Shop LLC, doing business as Waist Gang Society, and Nakeitha Felder, also known as Premadonna87, alleging trademark infringement.

According to the complaint, the plaintiff sells swimwear and shapewear using the mark Miraclesuit and other Miracle marks.

The plaintiff holds the defendants responsible because the defendants allegedly promoted their shapewear and waist-slimming products under the plaintiff's Miracle marks online.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendants, enjoin the defendants and their agents from further infringing plaintiff's trademark, order the destruction of all infringing materials and products, order to cancel all other domain names and social media web pages that the defendants control containing the Miracle marks, pay all profits to the plaintiff, damages, interest, punitive damages, court costs and any further relief the court grants.
