C. Caramanico & Sons Inc. alleged to have terminated Hispanic employee in retaliation

PHILADELPHIA – A Haverford resident alleges his Upland commercial landscaping company employer terminated him in retaliation for his complaints about not receiving overtime pay.

Kelvin Correa filed a complaint on behalf of himself and others similarly situated on Sept. 27 in the U.S. District Court for the Eastern District of Pennsylvania against C. Caramanico & Sons Inc. alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff alleges that between 2014 and 2016, he worked as a foreman/crew leader for the defendant and worked for more than 40 hours per week but was not paid any overtime compensation for hours worked that exceeded 40. 

The plaintiff holds C. Caramanico & Sons Inc. responsible because the defendant allegedly discharged him in November 2016 due to his repeated complaints to the management about not getting paid for overtime work and because he is Hispanic.

The plaintiff requests a trial by jury and seeks compensatory damages, back pay, front pay in lieu of reinstatement, lost benefits, negative tax consequence damages, punitive damages, court costs, relief directing the defendant to cease any and all unlawful retaliation against the plaintiff, and any further relief this court grants.
