PHILADELPHIA – A Delaware man alleges he was injured while working for Amtrak.
Scott Fleming filed a complaint on Sept. 25 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp. (Amtrak) citing the Federal Employers' Liability Act.
According to the complaint, the plaintiff alleges that on Nov. 18, 2016, he worked as a car repairman for the defendant in Delaware and was assigned to install a ceiling panel in a car. He alleges that as he was standing on a stool and stepping off of it, he tripped and fell over another stool that was placed by another co-worker. He alleges suffered serious physical injuries to his neck, right shoulder and wrist.
The plaintiff holds National Railroad Passenger Corp. (Amtrak) responsible because the incident was allegedly caused by the negligence of the defendant in its agents, servants, workmen and/or employees.
The plaintiff seeks judgment against the defendant in an amount of more than $150,000. He is represented by Michael J. Olley and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
