Carpenters Combined Funds Inc. seeks more than $100,000 from Johnstown company

JOHNSTOWN – A Johnstown company is alleged to have failed to pay contributions to a labor union fund.

Carpenters Combined Funds Inc. filed a complaint on Sept. 20 in the U.S. District Court for the Western District of Pennsylvania, Johnstown Division against Johnstown Construction Services LLC alleging violation of the Employee Retirement Income Security Act and the Labor-Management Relations Act.

According to the complaint, the plaintiff alleges that the defendant has not paid contributions from May to July of this year.

The plaintiff holds Johnstown Construction Services LLC responsible because the defendant allegedly breached its contractual agreement with the plaintiff by failing to remit its monthly contributions.

The plaintiff seeks to enjoin the defendant from further violating the terms of the agreement, payment of all monies past due, require the defendant to file a complete and accurate remittance reports, order the defendant to present for an audit, money judgment of $101,952.70 plus all additional amounts, liquidated damages, attorneys' fees of 20 percent of total amount due, court costs and any further relief this court grants.
