PITTSBURGH – A company engaged in the cold storage and food processing industry with a location in Montgomeryville is accused of making false statements to compete with another company.
Polyguard Products Inc. filed a complaint on Sept. 21 in the U.S. District Court for the Western District of Pennsylvania against Innovative Refrigeration Systems Inc. alleging patent infringement and false advertising.
According to the complaint, the plaintiff is the successor by assignment of the '509 patent and that the defendant is infringing this patent. The plaintiff alleges the defendant's IRS-1726 product is also advertised as having the same properties as competitive products, but the plaintiff claims that this is not so.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, to enjoin the defendant from using false descriptions and misrepresentations, court costs and any further relief the court grants.
