Torrado Construction Co. alleged to have failed to pay labor union contributions

PHILADELPHIA – A Philadelphia company is alleged to have failed to pay contributions to several labor union funds.

Cement Masons' Union Local No. 592 Pension Fund, Cement Masons' Union Local No. 592 Welfare Fund, et al. filed a complaint on Sept. 28 in the U.S. District Court for the Eastern District of Pennsylvania against Torrado Construction Co. Inc. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant has not timely reported or paid contributions as required under the contracts from December 2015 to present. The plaintiffs hold Torrado Construction Co. Inc. responsible because the defendant also allegedly breached its bargaining agreement with the plaintiffs by failing to submit remittance reports for December 2015, February through July 2016 and November 2016 to present.

The plaintiffs seek enjoin the defendant from continuing to violate the terms of the collective bargaining agreement, order the defendant to permit an audit of all records, and any further relief the court deems just. They are represented by Maureen W. Marra of Jennings Sigmond P.C. in Philadelphia.
