Precision Home Health Care Inc. alleged to have terminated employee after request for FMLA leave

SCRANTON – A Pine Grove woman alleges her former Pottsville employer failed to accommodate her disability and terminated her after she requested a medical leave.

Margaret Gurski filed a complaint on Sept. 25 in the U.S. District Court for the Middle District of Pennsylvania against the and Aida Lone citing the Family and Medical Leave Act.

According to the complaint, the plaintiff was employed by the defendants from May 2014 and August 2016 as a certified nursing assistant. The suit states she informed the defendants in August 2015 of her diagnosis of chronic lymphatic leukemia and shortly afterward, her position was changed and her pay rate was reduced. She alleges the defendants also refused her accommodation of eight-hour shifts instead of 12.

The suit states that the plaintiff was terminated five days after she requested FMLA leave.

The plaintiff requests a trial by jury and seeks judgment against the defendants, economic damages for lost income and benefits, front pay economic damages, restore plaintiff's full income and benefits, liquidated damages, court costs and any further relief the court grants.
