Class action seeks damages over Tate & Kirlin collection letter

PHILADELPHIA — An individual has filed a class-action lawsuit against a debt collector, citing alleged misrepresentation in debt collection.

Michael Marconi filed a complaint on behalf of all others similarly situated, on Oct. 3 in the U.S. District Court for the Eastern District of Pennsylvania against Tate & Kirlin Associates Inc. and John Does 1-25, alleging they sent a collection letter to the plaintiff that contains contradicting statements regarding his debt.

According to the complaint, the plaintiff alleges he received a collection letter from a debt collector that contains contradicting statements that caused confusion and damages. The plaintiff holds the defendants responsible because the letter allegedly stated that a negative mark could be reflected on his credit report and that he won't be sued or it won't be reported to any credit-reporting agency due to the age of his debt.

The plaintiff requests a trial by jury and seeks award class statutory damages, award class actual damages, court costs, interest and any further relief this court grants. He is represented by Antranig Garibian of Garibian Law Offices P.C. in Philadelphia.
