RRR Hotel LLC seeks more than $100,000 from insurer for allegedly failing to pay for damages

PHILADELPHIA – An Exton hotel alleges its insurer refused to cover property damages.

RRR Hotel LLC, doing business as Clarion Hotel and Conference Center, filed a complaint on Oct. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Selective Insurance Co. of South Carolina alleging breach of contract.

According to the complaint, the plaintiff's property was insured by the defendant and on April 12, an underground pipe broke and damaged the property. The plaintiff alleges it paid to clean up, repair the pipe and remove the pollutants.

The plaintiff holds Selective Insurance Co. of South Carolina responsible because the defendant allegedly breached their contractual agreement with the plaintiff by refusing to pay the damages done to its property despite as required by the policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $100,000 plus interest, court costs and any further relief this court grants. It is represented by Jeffrey P. Resnick of Sherman, Silverstein, Kohl, Rosee & Podolsky in Moorestown, New Jersey.
