Woman seeks reinstatement of benefits from Life Insurance Co. of North America

PITTSBURGH – A Finleyville woman alleges her disability benefits were wrongfully terminated.

Linda Wallace filed a complaint on Sept. 28 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America and USI Insurance Services LLC Employee Benefit Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that between 2014 and 2017, and was receiving short-term disability benefits and long-term disability benefits because of her lupus diagnosis. The suit states that the defendant terminated her long-term disability benefits in March. She alleges her benefits were wrongfully terminated because her medical condition prevents her from performing any occupation.

The plaintiff seeks declaration that the defendants are obligated to pay the plaintiff her past-due disability benefits, award retroactive long-term disability benefits and reinstate future benefits, award court costs, interest and any further relief the court grants. She is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
