Sales manager claims Bell-Mark Technologies didn't pay overtime wages

HARRISBURG — An employee has filed a class action lawsuit against an employer, citing alleged unpaid wages, violation of state law and violation of Workers' Compensation acts.

Jeffrey Berger filed a complaint on behalf of all others similarly situated Oct. 6 in the U.S. District Court for the Middle District of Pennsylvania against Bell-Mark Technologies Corp., alleging it failed to properly compensate the plaintiff for his work.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours as a regional sales manager but was not paid overtime wages. The plaintiff holds Bell-Mark Technologies responsible because the defendant allegedly did not pay overtime wages at the rate of 1.5 times the regular rate for hours worked over 40 per week.

The plaintiff requests a trial by jury and seeks pay commissions, liquidated damages equal to the wages due, interest, court costs, enjoin the defendant and further relief this court grants. He is represented by Derrek W. Cummings, Larry A. Weisberg and Steve T. Mahan of McCarthy Weisberg Cummings P.C. in Harrisburg.
