PHILADELPHIA — An employee has filed a class action lawsuit against an employer, citing alleged unpaid wages, violation of applicable minimum wage law, and violation of Workers' Compensation acts.

Austin Shockley filed a complaint on behalf of those similarly situated Oct. 11 in the U.S. District Court for the Eastern District of Pennsylvania against GoBrands Inc., doing business as GoPuff Inc., alleging it failed to properly compensate the plaintiff for his working hours.

According to the complaint, the plaintiff alleges he worked as a delivery driver and was required to work more than 40 hours per week but was not paid overtime wages. The plaintiff holds the defendant responsible because it allegedly failed to pay the plaintiff wages including overtime for hours worked that exceed 40.

The plaintiff requests a trial by jury and seeks unpaid overtime wages, unpaid minimum wages, all unpaid wages, interest, court costs, and any further relief this court grants. He is represented by Patricia A. Barasch of Schall & Barasch LLC in Moorestown, New Jersey; Alexander Hood and David Seligman of Towards Justice in Denver; and Rachhana T. Srey, Robert L. Schug and Brittany B. Skemp of Nichols Kaster PLLP in Minneapolis.
