Golden Gate National Senior Care LLC seeks to stay Cambria court proceeding

JOHNSTOWN – The operators of a skilled nursing facility in Cambria County are seeking to compel arbitration regarding a suit filed in that county's court.

Golden Gate National Senior Care LLC; GGNSC Johnstown LP, doing business as Golden Livingcenter - Richland; et al. filed a complaint on Oct. 9 in the U.S. District Court for the Western District of Pennsylvania, Johnstown Division against Ethel M. Spoone, executrix for the estate of Larry A. Spoone, seeking to compel arbitration and stay proceedings in a suit in the Cambria County Court of Common Pleas.

According to the complaint, Ethel Spoone filed a complaint in the Cambria court in October regarding Larry Spoone's care at the GL-Richland skilled nursing facility. The suit states that the decedent signed an alternative dispute resolution agreement (ADR) when he entered the facility in September 2015 and that the defendant's claims are covered disputes within that agreement. The plaintiffs allege that a valid and enforceable arbitration agreement exists that covers the disputes.

The plaintiffs seek enjoin the defendant from further pursuing claims in the Court of Common Pleas of Cambria County Pennsylvania. They are represented by Patrick L. Mechas and Andrew C. Hazi of Burns White LLC in Pittsburgh.
