Woman claims Liberty Life Assurance did not provide fair review of benefit claim

HARRISBURG – A Harrisburg woman alleges that she is owed payment of past-due disability benefits that were wrongfully denied.

Vicki Trott filed a complaint on Oct. 9 in the U.S. District Court for the Middle District of Pennsylvania against Liberty Life Assurance Co. of Boston citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff was employed as an associate customer service representative by Highmark, which had a policy through the defendant. The suit states the plaintiff stopped working in January 2015 and that she was paid short-term disability benefits from Jan. 20 to July 20, 2015, but denied her claim for long-term disability benefits in September 2015.

The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly denied the plaintiff a full and fair review of all her records and breached its promise to provide her certain long-term disability benefits.

The plaintiff seeks declaration that she is disabled and entitled to the payment of benefits under the long-term disability plan, declare plaintiff's rights to benefits under the terms of the long-term disability plan, payment of all past due benefits plus interest, court costs and any further relief the court grants. She is represented by Mary LeMieux-Fillery of Martin Law in Philadelphia.
