MetroPCS accuses individuals of conspiracy to commit fraud

PHILADELPHIA – A mobile carrier company alleges it has been harmed by a handset theft and trafficking scheme.

MetroPCS, a brand of T-Mobile USA Inc., filed a complaint on Oct. 12 in the U.S. District Court for the Eastern District of Pennsylvania against Isaiah Michael Thomas, individually and doing business as Go Phonez; Zamir Jefferson; Christopher Alexander T. Johnson; et al. alleging unfair competition, conspiracy to commit fraud and fraudulent misrepresentation and other counts.

According to the complaint, the plaintiff alleges that the defendants have profited at its expense "from the illegal acquisition and resale of new MetroPCS handsets by stealing the financial investments that plaintiff makes in the handsets."

"By obtaining the MetroPCS handsets through theft or fraud and diverting them to other markers where cellphones are not subsidized, the scheme converts plaintiff's investment dollars into profits for defendants and their co-conspirators," the complaint states.

The plaintiff requests a trial by jury and seeks compensatory, consequential, statutory and special damages; lost profits; exemplary damages; interest; court costs; permanent injunction; order the defendant to deliver to the plaintiff their entire inventory of phones and products bearing plaintiff's mark; and any further relief the court grants.
