Man seeks disability benefits from UPS plan, Aetna

PHILADELPHIA – A West Grove man has filed a lawsuit alleging that he is entitled to disability benefits.

Scott Schwartzengraber filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Pennsylvania against United Parcel Service Inc. Flexible Benefits Plan and Aetna Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in September 2016, he became disabled as the result of a post-traumatic stress disorder and applied for short-term disability benefits, which was initially approved but was later terminated. 

The plaintiff holds United Parcel Service Inc. Flexible Benefits Plan and Aetna Life Insurance Co. responsible because the denial of the plaintiff's benefits was allegedly in violation of the plan discretion.

The plaintiff seeks judgment against the defendants in an amount equal to the short-term disability benefits entitled to the plaintiff, damages, court costs, surcharge and any further relief the court grants. He is represented by Edward C. Sweeney of Wusinich & Brogan P.C. in Downingtown.
