PITTSBURGH – A Pittsburgh woman claims that a defective hernia mesh caused her injury.
Caroline Ideluca filed a complaint on Oct. 19 in the U.S. District Court for the Western District of Pennsylvania against C.R. Bard Inc. and Davol Inc. alleging strict liability - manufacturing defect and other counts.
According to the complaint, the plaintiff underwent hernia surgery in 2003 utilizing the defendants' Marlex Mesh. She alleges she needed later surgeries to correct damages caused by the mesh, which she alleges is defective.
The plaintiff holds C.R. Bard Inc. and Davol Inc. responsible because the defendants allegedly were negligent in failing to design the mesh and failing to use proper materials in the design and manufacture of it that would not cause it to contract and/or migrate to other organs.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory and punitive damages, court costs, interest and any further relief the court grants. She is represented by Rolf Louis Patberg of Patberg Law Firm in Pittsburgh.
