Former railroad worker seeks disability benefits from Kansas City Southern Welfare plan

PITTSBURGH – A Louisiana man alleges his disability benefits were wrongfully terminated.

Daniel Russell filed a complaint on Oct. 19 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America and Kansas City Southern Welfare Benefit Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2010, he became disabled and was unable to work after working as an operations manager for a railroad for 32 years. The suit states that long-term disability benefits were approved and then later terminated in July 2015.

The plaintiff holds Life Insurance Co. of North America and Kansas City Southern Welfare Benefit Plan responsible because the plaintiff alleges that he is entitled to benefit coverage because his medical conditions prevent him from performing the duties of any occupation.

The plaintiff seeks order for the defendants to pay the plaintiff past due benefits, pay $110 per day for failure and/or refusal to provide requested plan documents, award retroactive long term disability benefits and reinstate future benefits, court costs and any further relief the court grants. He is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
