Golden Gate National Senior Care seeks to stay negligence suit in Blair County court

JOHNSTOWN – The operators of a Blair County skilled living facility are seeking to stay a Cresson couple's suit against them.

Golden Gate National Senior Care LLC, et al. filed a complaint to compel arbitration and stay proceedings on Oct. 18 in the U.S. District Court for the Western District of Pennsylvania against Rae A. Loar and Gary J. Loar.

According to the complaint, Rae A. Loar was a resident at the plaintiffs' GGNSC Altoona Hillview LP skilled living facility in Blair County from December 2015 to February 2016. The suit states that shortly after her admission, Gary Loar as her agent executed an admission agreement and voluntary alternative dispute resolution agreement. The plaintiffs allege the alternative dispute resolution agreement provides for arbitration.

The suit states that the defendants filed a general docket civil action in the Blair County Court of Common Pleas in September over allegations that Rae Loar sustained injuries as a result of negligent care provided by the plaintiffs' staff. The plaintiffs allege that a valid and enforceable arbitration agreement exists that covers these allegations.

The plaintiffs seeks a order for the defendants compelling them to all claims to arbitration in accordance with the alternative dispute resolution agreement, court costs and any further relief the court grants. They are represented by William M. Buchanan and Patrick L. Mechas of Burns White LLC in Pittsburgh.
