Amtrak employee seeks more than $150,000 after allegedly falling down steps while cleaning

PHILADELPHIA – A Hyattsville, Maryland woman employed by Amtrak as a coach cleaner alleges that she was injured while working.

Mirian Gomez filed a complaint on Oct. 25 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp. (Amtrak) alleging negligence.

According to the complaint, the plaintiff alleges that on June 27, 2016, she sustained serious physical injuries while mopping the floor and stairs of Amtrak car number 34050, including injuries to her right ankle, right leg and low back. She alleges she slipped and fell down stairs because of their unsafe condition.

The plaintiff holds National Railroad Passenger Corp. (Amtrak) responsible because the defendant allegedly failed to properly inspect and repair the condition of the stairs, failed to instruct the plaintiff not to work in the area of the steps until they could be properly maintained, and failed to warn the plaintiff of the steps' condition.

The plaintiff seeks judgment against the defendant in an amount of more than $150,000. She is represented by Michael J. Olley of Coffey Kaye Myers & Olley in Bala Cynwyd.
