Former HR employee for Northwest Tri-County Intermediate Unit alleges wrongful termination

PITTSBURGH – A Girard woman alleges her Edinboro employer wrongfully terminated her after she took a medical leave.

Abigail Stafford filed a complaint on Oct. 25 in the U.S. District Court for the Western District of Pennsylvania against the Northwest Tri-County Intermediate Unit and Dean Maynard citing the Family and Medical Leave Act and the Pennsylvania Whistleblower Law.

According to the complaint, the plaintiff was hired by Northwest Tri-County Intermediate Unit in July 2006 and promoted to acting director of human resources in October 2014. She alleges that she sustained damages from being terminated from employment for going on a leave of absence in early 2017 to address her health issues. 

The plaintiff holds Northwest Tri-County Intermediate Unit and Maynard responsible because the defendants allegedly terminated plaintiff's employment based on their claim that she already exhausted all of her FMLA leave despite the fact the plaintiff had never completed any paperwork regarding her FMLA rights. She also alleges that she was retaliated against for reporting wrongdoing earlier in her employment.

The plaintiff seeks judgment against the defendants, compensatory damages, lost wages, front pay, back pay, benefits, other compensation and actual monetary loss, court costs and any further relief the court grants. She is represented by Marcus B. Schneider of Steele Schneider in Pittsburgh.
