Madison National Life Insurance alleged to have wrongfully denied disability benefits

SCRANTON – A Frackville woman alleges that she is disabled and her claim for disability benefits was wrongfully denied.

Ruta Kretulskie filed a complaint on Oct. 26 in the U.S. District Court for the Middle District of Pennsylvania against Madison National Life Insurance Co. Inc. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she was diagnosed with osteoporosis of the spine and applied for long-term disability benefits with the defendant's plan but was denied. 

The plaintiff holds Madison National Life Insurance Co. Inc. responsible because the defendant allegedly upheld its decision to deny plaintiff's disability benefits based on its claim that she does not meet the definition of disability in the policy.

The plaintiff seeks declaratory relief, damages equal to the long-term disability benefits entitled to her, court costs and any further relief the court grants. She is represented by Joseph H. Jones Jr. of Williamson, Friedberg & Jones LLC in Pottsville.
