Force Therapeutics LLC seeks to enjoin university from using Force mark

PHILADELPHIA – The University of Massachusetts Medical School is alleged to have infringed on a New York company's trademark.

Force Therapeutics LLC filed a complaint on Nov. 2 in the U.S. District Court for the Eastern District of Pennsylvania against University of Massachusetts Medical School alleging trademark infringement.

According to the complaint, the plaintiff operates in the orthopedic care management field and is the owner of the Force Therapeutics and Force mark.

The plaintiff holds University of Massachusetts Medical School responsible because the defendant allegedly used the Force marks in connection with "services directly related to and overlapping with those of Force," the suit states, and that "numerous incidents" of confusion in the medical community has occurred as a result.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trademark, order the defendant to surrender immediately for destruction all infringing materials, pay profits to the plaintiff, damages, treble damages, court costs and any further relief the court grants.
