FMC2 Inc., Fleetway Leasing Co. allege they are owed more than $600,000

PHILADELPHIA – A Pennsylvania company and its affiliate allege that they are owed payment for the leasing of vehicles.

FMC2 Inc. and Fleetway Leasing Co. filed a complaint on Nov. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Auto Boutique of South Florida Inc., doing business as Auto Boutique; Howard Elfand; and Yousseff Aziz alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiffs allege that in November 2014, FMC2 and Auto Boutique entered into a master lease agreement and that Elfand and Aziz personally guaranteed its obligations on the lease. The plaintiffs allege that Auto Boutique failed to pay a June 2016 invoice and Aziz and Elfand failed to cure the default.

The plaintiffs seek judgment against the defendants in the amount of $690,658.36 plus interest and any further relief the court grants. They are represented by Jessica M. Gulash of Lundy, Beldecos & Milby PC in Narberth.
