Dallas property owners allege sellers provided false disclosure statement

WILKES-BARRE – A Dallas, Pennsylvania, couple allege that they have paid at least $75,000 more for a property they purchased because the disclosure statement failed to list some defects with the property.

Justin Shaffern and Ashley Shaffern filed a complaint on Oct. 30 in the U.S. District Court for the Middle District of Pennsylvania against Matthew Sowcik and Lori Sowcik citing the Pennsylvania Real Estate Seller Disclosure Law.

According to the complaint, the plaintiffs entered into an agreement of sale with the defendants for their current Dallas property. They allege that the disclosure statement on the property stated that a B-Dry system was used when the basement was remodeled. The plaintiffs allege that no such system exists on the property and that other claims in the statement also were misrepresented or omitted. 

The plaintiffs hold the Sowciks responsible because the defendants allegedly provided a disclosure statement to the plaintiff that contains false, deceptive and misleading information.

The plaintiffs request a trial by jury and seek damages, treble damages, punitive damages, court costs and any further relief this court grants. They are represented by Peter C. Wood Jr. of Law Office of Peter C. Wood Jr. PC in Kingston.
