WILKES-BARRE – A Scranton woman alleges she was injured when her wheelchair tipped over.
Cynthia Egan filed a complaint on Nov. 2 in the U.S. District Court for the Middle District of Pennsylvania against Hoveround Corp. alleging strict liability and negligence.
According to the complaint, the plaintiff alleges that on Nov. 3, 2015, she sustained physical injuries, including a shattering injury to her femur and fractures to other parts of her body, when the battery-operated power wheelchair she was riding suddenly tipped over and fell on her. The suit states she was using the defendant's Hoveround MPV 5.
The plaintiff holds Hoveround Corp. responsible because the defendant allegedly failed design and manufacture the wheelchair with safeguards to prevent it from tipping.
The plaintiff seeks judgment against the defendant for compensatory damages of more than $75,000 plus interest and any further relief the court grants. She is represented by James F. Mundy of Powell Law in Scranton.
