R & B Contracting & Excavation Inc. alleged to owe more than $30,000 to union funds

PITTSBURGH – A West Homestead construction company is alleged to have failed to pay contributions to a union's funds per the terms of a bargaining agreement.

The board of trustees of Cement Masons' Local 526 Combined Funds Inc. filed a complaint on Nov. 2 in the U.S. District Court for the Western District of Pennsylvania against R & B Contracting & Excavation Inc., William Rodgers, Richard Roscoe, Daniel Amato and Does 1-50 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that it has not received payments from R & B Contracting & Excavation Inc. for work done by its employees for June to September 2017. The plaintiff alleges that it is owed $34,193.34 for fringe benefits, dues and payroll.

The plaintiff seeks money judgment in the amount of $34,193.34 plus costs, fringe benefits owed, administration and audit costs, interest, court costs and any further relief the court grants. It is represented by Stephen J. O'Brien and Andrew L. Ciganek of Stephen J. O'Brien & Associates in Pittsburgh, Pennsylvania.
