JOHNSTOWN – A Hollsopple metal powder manufacturer alleges a Florida business failed to pay for goods provided.
North American Hoganas Co. filed a complaint on Nov. 2 in the U.S. District Court for the Western District of Pennsylvania against Whertec Inc. alleging breach of contract.
According to the complaint, the plaintiff alleges that it provided a powder to the defendant in 2016.
The plaintiff holds Whertec Inc. responsible because the defendant allegedly failed and/or refused to pay the plaintiff within 30 days from the date of the invoice for the products it received from the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest and any further relief the court grants. It is represented by Michael J. Parrish Jr. and Toby D. McIlwain of Spence, Custer, Saylor, Wolfe & Rose LLC in Johnstown.
