PITTSBURGH – A Fair Oaks resident claims that a Florida debt collector is unlawfully calling him.
Peter Kaufmann filed a complaint on Oct. 30 in the U.S. District Court for the Western District of Pennsylvania against Medical Data Systems Inc. citing the Telephone Consumer Protection Act and other counts.
According to the complaint, the plaintiff alleges that he has received several collection calls on his cellular telephone from the defendant in an attempt to collect an alleged debt. He alleges he told the defendant to stop calling him in September 2016
The plaintiff holds Medical Data Systems Inc. responsible because the defendant allegedly kept on calling the plaintiff using an automatic telephone dialing system despite his request to stop and called him without his consent.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages, enjoin the defendant from placing further calls to the plaintiff's cellular telephone, court costs and any further relief this court grants.
