READING – A Philadelphia man alleges that a Plymouth Meeting landscaping contractor failed to pay him the appropriate rate for overtime way.
Melvin Rivera filed a complaint on Nov. 7 in the U.S. District Court for the Eastern District of Pennsylvania against Brad Byrne Complete Lawn Maintenance and Brad Byrne alleging violation of the Federal Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiff alleges that in 2015, he starting working as a landscaper for the defendants.
The plaintiff holds Brad Byrne Complete Lawn Maintenance and Byrne responsible because the defendant allegedly failed to pay overtime pay to the plaintiff at the rate of one-and-a-half times his hourly rate for hours worked that exceeded 40 per week.
The plaintiff seeks unpaid overtime wages, court costs, negative tax consequence damages, interest and any further relief the court grants. He is represented by Franklin J. Rooks Jr. of Jacobson & Rooks LLC in Marlton, New Jersey.
