PHILADELPHIA – A Bensalem company alleges that its product design was stolen.
Pedibrush LLC filed a complaint on Nov. 7 in the U.S. District Court for the Eastern District of Pennsylvania against Catalog Solutions Inc., Winning Solutions Inc., Curtis A. Clarke, Jess Clarke III and New Products Solutions alleging breach of contract and other counts.
According to the complaint, the plaintiff is the creator, manufacturer and marketer of the PediBrush. The suit states the plaintiff contracted Catalog Solutions and Clarke to help market the product in 2011.
The suit states on Oct. 28, the plaintiff's principals discovered a Miracle Foot Brush being sold online that is a "virtual mirror image" of the PediBrush. The plaintiff alleges that its original photos had been misappropriated and that the defendants were manufacturing the product.
The plaintiff holds Catalog Solutions Inc., Winning Solutions Inc., Curtis A. Clarke, Jess Clarke III and New Products Solutions responsible because the defendants allegedly misappropriated plaintiff's designs and product images. It alleges it has suffered financial losses and it will continue to do so unless the defendants are ordered to cease and desist sales of the Miracle Foot Brush.
The plaintiff seeks enjoin the defendants, order to pay the plaintiff for all damages, and any further relief the court grants. It is represented by Mark T. Sophocles and E. William Hevenor of Law Offices of Mark T. Sophocles in Paoli.
