Former Abington Reldan Management employee alleges discrimination, FMLA interference

PHILADELPHIA – A Philadelphia man alleges that he was wrongfully terminated by his former Fairless Hills employer.

Miguel Ortiz filed a complaint on Nov. 6 in the U.S. District Court for the Eastern District of Pennsylvania against Abington Reldan Management Inc. and Abington/Reldan Refining & Recycling LLC, also known as Abington Reldan Metals LLC, citing the Family and Medical Leave Act

According to the complaint, the plaintiff was hired by the defendants as a granular operator and forklift operator in August 2012. He alleges he was informed that he would not be given raises or bonuses because of his race and because he does not speak English. He also claims that he was not provided FMLA protection and benefits for medical issues in November 2014. He alleges he was terminated on Nov. 7, 2015.

The plaintiff holds Abington Reldan Management Inc. and Abington/Reldan Refining & Recycling LLC responsible because the defendants allegedly discriminated against and terminated him because of his race and because he attempted to exercise his FMLA rights.

The plaintiff requests a trial by jury and seeks compensatory damages, income and benefits, punitive damages, interest, court costs and any further relief the court grants. He is represented by Marc A. Weinberg of Marc A. Weinberg, Esquire in Jenkintown.
