Investor alleges TD Ameritrade, financial adviser 'gambled away' retirement funds

PHILADELPHIA – A New Jersey resident has filed suit over the management of her investments by a Conshohocken financial adviser.

Marianne Antczak filed a complaint on behalf of herself and other similarly situated persons on Nov. 3 in the U.S. District Court for the Eastern District of Pennsylvania against TD Ameritrade Clearing Inc., TD Ameritrade Inc., TD Ameritrade Investment Management LLC, Ultimate Financial Investments LLC and Bridget A. Fernandez alleging breach of fiduciary duty, negligence, breach of contract and other counts.

According to the complaint, the plaintiff alleges Fernandez, a registered investment adviser, "essentially gambled away most of plaintiff's retirement funds" through Fernandez's Ultimate Financial Investments. The plaintiff alleges Fernandez over-concentrated the plaintiff's money in daily leverage exchange-traded funds and also used this "wildly unsuitable investment strategy" for the majority of her customers' TD Ameritrade brokerage accounts.

The plaintiff requests a trial by jury and seeks order the defendants to take all necessary actions to reform and improve their internal policies and procedures to protect reoccurrences of the damaging events, award all court costs to the plaintiff and any further relief this court grants. She is represented by Theodor A. Swansen of Taswansen LLC in Philadelphia.
