Selective Insurance Co. of the Southeast alleged to have breached obligations in collision case

PHILADELPHIA – A Horsham couple have filed a lawsuit against their insurer after a collision with an underinsured motorist.

Simon McIvor and Kathy McIvor filed a complaint on Nov. 13 in the U.S. District Court for the Eastern District of Pennsylvania against Selective Insurance Co. of the Southeast alleging that an underinsured operator failed to properly control the vehicle.

According to the complaint, the plaintiffs allege that on May 28, 2015, Simon McIvor sustained severe physical injuries in a collision in Lansdale with an allegedly negligent underinsured motorist.

The plaintiffs hold Selective Insurance Co. of the Southeast responsible because the defendant has allegedly breached its obligation to the plaintiffs regarding underinsured motorist benefits.

The plaintiffs seek judgment against the defendant in an amount of more than 75,000 plus interest and court costs. They are represented by Robert S. Miller of Wapner, Newman, Wigrizer, Brecher & Miller in Philadelphia.
