Goddard Systems Inc. alleges North Carolina facility is unlawfully using marks after termination of agreement

PHILADELPHIA – The King of Prussia franchisor of The Goddard School alleges a facility in North Carolina continues to use its marks after their agreement was terminated.

Goddard Systems Inc. filed a complaint on Nov. 13 in the U.S. District Court for the Eastern District of Pennsylvania against Lea Blazey Gombar, Laavanya Gombar and Our Future's Education LLC alleging trademark infringement and breach of contract.

According to the complaint, the Gombars entered into a franchise agreement with the plaintiff in June 2016 to operate a Goddard School in North Carolina. The suit states that the defendants failed to comply with the obligations under the agreement and it was terminated Oct. 30.

The plaintiff holds Lea Blazey Gombar, Laavanya Gombar and Our Future's Education LLC responsible because the defendants allegedly continued to operate the school using the plaintiff's marks after the termination of the agreement.

The plaintiff seeks preliminary and permanent injunction against the defendants enjoining them from further infringing plaintiff's marks, monetary damages, compensatory damages, lost profits, exemplary damages, punitive damages, court costs, treble damages, interest, and any further relief the court grants. It is represented by Constantine T. Fournaris of Wiggin and Dana LLP in Philadelphia.
