Pittston couple claim Peterbilt truck was defective, caused husband's burn injuries

SCRANTON – A Pittston couple is seeking more than $150,000 after the husband was allegedly burned while working on a truck.

James Burnside and Maria Burnside filed a complaint on Sept. 20 in the U.S. District Court for the Eastern District of Pennsylvania against Peterbilt Motors Co., Arrow Tank and Engineering Co., RegO Products and Federal Tank Testing Inc. alleging products liability, negligence and other counts.

According to the complaint, the plaintiffs allege that on July 21, James Burnside sustained burns to his face, hands and arms when the Peterbilt bobtail truck he was working on began leaking propane gas and caught fire. 

The plaintiffs hold Peterbilt Motors Co., Arrow Tank and Engineering Co., RegO Products and Federal Tank Testing Inc. responsible because the defendants allegedly placed a defective product into the stream of commerce.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount of more than $150,000 plus court costs, interest and any further relief the court grants. They are represented by Brandon A. Swartz, Bryan M. Ferris and Maria K. McGinty-Ferris of Swartz Culleton PC in Newtown.
